A provision which sets up an appeal process in respect of origin determination and advance rulings.
Depending on the details of the provision, the appeal process can be available in the country of import for domestic importers as well as for exporters from the FTA partner country.
Example:
An exporter provides a certificate of origin to the importer who submits it to the local customs authorities together with other customs supporting documentation. The customs authorities reject the preferential origin claim as the commercial invoice was provided by a third party and there is no clarification of the treatment of third party invoicing under the FTA. Based on the appeal provision, the exporter has the ability to appeal directly to the local customs authorities and have the case independently reviewed.
